Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of talkfrenchcanada.co and the services offered by Talk French Canada (“TFC,” “we,” “us,” “our”). By creating an account or purchasing a plan, you agree to these Terms.

1. Eligibility and Account Creation

• You must be 18 years of age or older to create an account or purchase any Service.
• You must provide accurate, current information when creating your account and keep it up to date.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

2. Description of Services

TFC offers two distinct products. They are governed by the same Terms but have different delivery models:

2.1 High Ticket Coaching

Human-tutor-led coaching delivered by independent contracted tutors, billed as a monthly recurring subscription via PayPal. Sessions are scheduled with an assigned tutor according to the plan purchased.

2.2 Low Ticket SaaS

Self-serve digital access to the TFC platform (mock tests, practice materials, and related digital content), billed monthly via PayPal at $29.99, $49.99, or $79.99 USD depending on tier. No tutor sessions are included in SaaS-only plans unless explicitly stated at purchase.

3. Subscription Billing

• All plans are billed on a recurring monthly basis via PayPal, starting on the date of initial purchase and renewing on the same date each month unless cancelled.
• By subscribing, you authorize TFC to charge your PayPal account automatically each billing cycle.
• Prices are listed in USD and may change with notice; continued use after a price change constitutes acceptance of the new price for future cycles.
• It is your responsibility to ensure your PayPal account has sufficient funds/valid payment method on file. Failed payments may result in suspended access.

4. Acceptable Use

You agree not to:

• Share your account credentials or platform access with anyone not party to your subscription
• Reproduce, resell, redistribute, or publicly share any TFC content (mock tests, audio clips, video lectures, written materials)
• Use the Services for any unlawful purpose or in a way that disrupts other users or TFC’s systems
• Attempt to reverse-engineer, scrape, or extract TFC’s proprietary content or systems

Violation of this section may result in suspension or termination of your account without refund.

5. Intellectual Property

All content on the platform — including mock tests, audio clips, video lectures, written materials, and any other instructional content — is the exclusive property of Talk French Canada. Your subscription grants you a limited, non-transferable, non-exclusive license to access this content for your personal exam preparation only. No other rights are granted.

6. Limitation of Liability

To the maximum extent permitted by applicable law:

• TFC provides the Services on an “as is” and “as available” basis and makes no guarantee of exam results, certification outcomes, or immigration application outcomes.
• TFC is not liable for indirect, incidental, or consequential damages arising from use of the Services.
• TFC’s total liability for any claim arising from the Services is limited to the amount you paid TFC in the 3 months preceding the claim.

7. Dispute Resolution

If you have a concern or dispute, you agree to first contact TFC at support@talkfrenchcanada.co so we can attempt to resolve it directly. If a resolution cannot be reached informally within a reasonable period, either party may pursue the matter through the courts of competent jurisdiction as set out in Section 9 (Governing Law), or through PayPal’s independent dispute resolution process where applicable.

8. Termination

• By TFC: We may suspend or terminate your account, without refund, if you breach these Terms, misuse the platform, or engage in fraudulent activity.
• By you: You may cancel your subscription at any time as described in our Refund and Cancellation Policy. Cancellation takes effect at the end of your current paid billing period; no partial-period refunds are issued except as expressly stated in that policy.

9. Governing Law

These Terms are currently governed by the laws of the Kingdom of Morocco, reflecting TFC’s current legal status as a Moroccan SARL AU.

Transition notice: TFC intends to form a US or Canadian LLC (estimated within approximately 3 months of this document’s effective date). Upon formation of that entity, TFC may update this governing law clause and related dispute resolution terms to reflect the new corporate structure. Customers will be notified of any such change per Section 10.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last Updated” date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
